If you want to split hairs then you BOTH have the other pair of 3's so
Guy #1 is not talking about his hole cards. If you want the letter of
the law then no, the preflop folder should not have said anything. Did
he sound like he was joking when he said it? Did he sound like he's
pissed because he could have won a hand after loosing the last 3
showdowns? If it's the former then I would probably let it go as
friendly banter amongst players having a good time. If its the latter,
then I would have to weigh in on 1) is this guy tilting and I can take
him for some money or 2) Would I just as well not have this guy playing
here so lets make a stink about it so if it happens again I can get him
thrown out. If you truly think they were colluding then the situation
gets a whole lot more complicated because then you are going to have to
question the integrity of the dealer and floor manager and it would be
easier to just not play there.

There was a scene in last years WSOP where Shekihan slammed down his
hand on the table when the flop dropped (implying that he tossed some
kind of nut card(s)) and Matusow went ballistic on him. Some say this
was contrived for PR purposes but it's true, even non-verbal
indications of what you may have (or had) are against the rules. I
would keep an eye on it but if its a "friendly" B&M I would tolerate it
every once in a while.
