illegal. If you are caught, you are fined and your driver's license is
confiscated. You have to go to the police station to pay the fine and
reclaim the license. This is very big hassle if this happens to you
while you are out of town. Your ticket is your temporary license, good
for only 72 hours from the time the ticket is issued. The same law
applies for seatbelts.

Yes.....because they set up roadblocks especially on holiday weekends.
The transito office here in town must have 200 licenses in a file box
that people need to reclaim. SO got caught about two months ago for
smoking. While the fines aren't large by first world standards (100-200
lempira or 5-10 US dollars), for some people here that is one or two
days pay! So...you don;t see anyone smoking while driving. The seatbelt
and cellphone law just went into effect about two months ago. Oh...same
fines for failing to have a fire extinguisher and emergency road
triangles to set out at a distance from your car if you break down.
Must be working - the traffic deaths over the holiday weekend were 16
nationwide - down from about 70 deaths two years ago. More people died
from drowning at the beach this year than on the roads.

but smoking while driving? May I dare ask what happens if they catch
someone someone under the influence? or <horrors> eating something while
driving?
There is trial if you are drunk. You get arrested. The next morning you
see the magistrate for immediate sentencing to prison. Sentance depends
on wheter you were drunk, drunk and involved in an accident and whether
the accident had injuries or deaths associated with it. it's funny -
eating food or drinking is ok...but smoking isn't.
A colleague mother and sister were hit buy a bus while they were
crossing the street. The bus driver was an independent - not part of a
company. Hit and run - the guy tried to take off, pedestrians and
shopkeepers got the bus license number, and other info. They called the
transitos (transit police). My colleague's parents now own a bus and
the driver is in jail.
Immediate confiscation of the vehicle is another option here when a
serious infraction has occurred.
