Ah - in that case, they're by no means a thief. If the
link/URL provided was simply the one YOU used to distribute
the picture in the first place, then YOU retain complete control
over your "intellectual property." Granted, it was not a nice thing
for someone else to CLAIM that the picture was theirs, but that's
hardly the same thing as actually copying the picture itslef and
distributing it under their own control. You have no more basis
for a claim of "thievery" than you would have if you placed ANY
picture or other content on public display, and then got annoyed
because a passerby pointed to it and said "See that? I made
that!" It's not true, but it's hardly copyright infringement. Copyright
infringement is all about the control of the use and distribution of
content - and you've already voluntarily given up some degree of
control over both by choosing to put the picture in a place where
it is readily accessible to the public. Bad choice on your part,
perhaps, but not "james'" fault, whoever that is.

There isn't an easy way to delete the pic that I can see. I've
contacted tinypic.

A further problem for your case, then - you apparently didn't
check out how much control of the property in question prior to
posting it, so it seems pretty clear you didn't care all THAT much
about it or had considered the possible consequences (distribution
to or by others) in advance. Pretty hard now to claim "but I
didn't MEAN for it to get out in public!"

Nope, I'm not a lawyer - but this one seems pretty obvious.
