Okay, but at this point, the seller has said she would take the pony
back. Doesn't that eliminate my ability to sue? I am not returning the
pony because first of all she said she would give me a postdated check
and secondly I think she'd just dump the pony at auction. I would think
her offer of taking him back and returning my money would kind of
destroy any case I had against her.

I think suing in this situation is pretty foolhardy, considering the
amount involved. The woman sounds like pond scum, and I can only
imagine how it would play out. I would insist that she return any
amount over the originally agreed upon price since he does indeed have
vision issues.

I meant to mention in my previous post that I had to shake my head
over people flaming you for not doing a PPE and chiding you about
riding three days after bringing him home. Sheesh. Although, given
some time, he may improve dramatically but probably not enough to suit
your purpose.

I know several people with blind and partially blind or one eyed
animals that do very well. Again, don't think it's what you need, but
he could probably be a very useful pone. I have such a soft spot for
the wee ones :)

As an aside, remember that large pony my boarder was trying to lease
off or on farm? She found a family in RI with three children that
would be using him, seemed perfect, went and saw the place, etc etc.
When they came to pick him up on Sunday, the woman played Mickey the
Dunce over the $100 monthly fee as was advertised for an off farm
lease.

My boarder was so completely taken aback that she let them take the
pony. The woman insisted that A told the fee would be waived because
the most important thing was that he was going to a good home, but A
knows that she never said that.

Now, this is a large pony, 14.2, sound sound sound, broke broke broke,
17 years old, and so cute you want to put him on your shelf as a
decoration. He'll do pretty much anything without batting his long
eyelashes. A asked me what she should put down as his value when
filling out the lease paperwork prior to their arrival and I said put
5K. He's worth that and a stick of gold all day long.

The woman was shrill in her objection to his stated worth, etc etc, as
well as insisting that A told her it would be a free lease. They
don't have the money blah blah blah can't afford another payment yadda
yadda. I didn't like the smell coming off of this chick from the
minute she stepped out of the truck. She's inside crying poor mouth
to A over the minuscule lease price, and her husband's outside offering
to buy everything he claps his beady eyes on, including the bloody
property!

Some people just suck.
