I can see if there was a warrant or if there was a court order tracking

All to often the 'legal' adviser to governing bodies are not qualified.
I bet the company selling the units to the police wrote the bill!

This is more than big brother.  I also think the same applies to cell phones
since they have GPS's in them as well and never turn off unless the battery is out.

Personal rights and the Bill of Rights be hanged so it seems.

I'm certainly no expert and might even be regarded as "gadget
challenged", but my cellphone definitely does not have GPS in it and
it definitely does turn off, or at least goes to "sleep" mode where it
does nothing pending a wakeup call.

Most electronic stuff works that way anymore, including digital
calipers. A momentary logic-level pushbutton switch is much cheaper
and smaller than a toggle or rocker switch, and about all
microcontroller chips have "sleep" modes where they consume negligable
power but can still respond to an input.

Uhh, you'd like to think so. There may not be a GPS that YOU can
access, but if it's a reasonably modern phone, it has a GPS that THEY
can access.

The hardware is there. Required by the FCC (a homeland security
thing). By law, the phone company is only supposed to give the
information out when you've dialed 911, but that doesn't meant they
don't have your position. It also doesn't mean that the "authorities"
couldn't get it from your cell provider.

Also, they can triangulate your position pretty closely from cell
towers. Even when you're in standby, your phone is communicating with
the towers, that's how they know how to make it ring.

fromhttp://www.maps-gps-info.com/gpcp.html:

Fortunately, the U. S. FCC (Federal Communications Commission) has
mandated a program called E911. E(nhanced) 911 requires the location
of any cell phone used to call 911 can be determined to within 50 to
100 meters. The law took effect at the start of 2005. That means cell
phone manufacturers have incorporated a GPS receiver in virtually
every cell phone.

And all cellular providers have Federal rules to follow on phasing
out all phones that do not have the E-911 functionality.  So you can't
get service established for an older digital phone without the
functionality, and the Analog systems were totally shut down for the
same reason.

If you are paranoid enough that you don't want them to know where
you are, turn off the cellphone and remove the battery.  Of course,
now you are out of contact with friends family and employers, so
you'll have to get a beeper for passive incoming messages - till they
outlaw beepers, too, because those "Eeeeevil Drug Dealers" use them.

If you want to start a war over this, you will have to do it in
court - bring lots of money.  And to make long term changes, you have
to get people politically involved in their community and their
government - but too many Sheeple just "vote straight ticket Democrat,
and the Government will take care of my every need."

But don't worry, if we let the Democrats stay in power and give them
another ten years, and they'll build the same functionality into your
new car by federal statute, and make it a vital part of the car
running.  Then start outlawing older cars...

And as soon as they figure out how, the Dems will build implantable
tracking transceivers that run on body heat that you must have in your
body, and contain a cyanide capsule they can trigger remotely if you
commit a felony crime.  Judge, Jury and Executioner as "the hand of
the Governmment" reaches out of the clear blue sky and smites you from
out of the ether...

How far down that road to utter paranoia do you want to go?  If we
allow it to happen, think of "1984" and "Soylent Green" (et. al.) as
the roadmap to hell.

Oh cut it out. The E911 GPS thing came from the Bush White House and
FCC under the guise of "homeland security." Right along with the
wiretaps.

But of course, you've forgotten all that.
