You? I think I'll let the
judge/jury decide.
Juries are emotional bodies and as long as they think it will just be
the insurance company paying the bill they award ridiculous judgments.
Notice the operator of the boat that killed the guy was not assessed a
dime.
Judges are reluctant to cut jury awards, they are usually elected
politicians.
So, throw out the jury system. Throw out judges. I guess you're left with
religious leaders.
I think I'll keep the two former.
In that regard, insurance companies and lawyers are in the scam
together. After all, torts are generally about insurance. That is why
the boat manufacturer was held liable and the dumb assed boat driver
wasn't when the driver was actually 100% at fault.
I bet the driver did not have insurance.
Huh? Torts happen when there is any wrongdoing for which action for
damages
can be brought. That's like saying airplane crashes generally happen to
airplanes.
"Any wrong doing" is in the imagination of the seamiest lawyer who
will solicit the "victim". That is what needs to be regulated.
Torts happen when there are deep pockets to exploit, usually an
insurance company. Nobody sues a bag lady unless they just want her to
move to another corner.
Nope. It's a legal concept. You're just angry with lawyers. Perhaps you
had
a bad experience. Again, HOW do you regulate the lawyers? Are you the one
who's qualified? Or, would it be another lawyer, like, say a judge.
Regulation? I said it before, why not a board of politicians and
bureaucrats like you want for all other regulation Fair is fair.
Because politicians are mostly lawyers and you want to trust them and
bureaucrats????
When OB/Gyns dropped their insurance in an attempt to be a less
attractive target it was the lawyers who forced legislation to get
them insured again.
?? Not familiar with this. Is it a federal law, a state law?
I am guessing state. Do you want me to look it up?
If you're making a claim like this, then it seems to me you should be able
to support it.
Again I bring up the boat propeller case. The operator was 100%
responsible, the captain of any vessel is the responsible party, but
they went after the engine manufacturer because they were the ones
with the money. Blaming the propeller design for this accident would
be like running over a kid with your car and suing the tire
manufacturer because the tire was what inflicted the fatal blow.
Somebody should have stopped this case before it started.
If that had been the case, then the suit would have likely been thrown
out.
Haven't been following the case. Is that what happened?
The case was not thrown out and the facts are fairly indisputable.
If the case wasn't thrown out, then I guess it was disputable.
If I turn around suddenly and cut your arm off with a chain saw, will
you try to sue Homelite?
That's not comparable.
Well probably, you seem to be a lawyer. They certainly have deeper
pockets than me.
Don't know. My pockets are about average for the clothes I wear.
