Actually, there is a note after Article 90 that says that the failure
of any party to have an observer does not invalidate the test.

I see that if the license-holder requests a
counter-analysis he has the right to be present, but the
counter-analysis may proceed when he does not appear for
it. Two questions:

Did Landis request a counter-analysis?

The press is confusing on that. I think Landis lawyer sent the request
at the "last minute". The UCI said that they scheduled the test before
getting the request.

If the license-holder does not request a counter-analysis
may the UCI unseal the B-sample anyway?

Yes. I think that is in Article 90.
