Clearly. How does one viewer have a meeting of minds with a network
programming executive?
You have probably implicitly agreed to contracts you were never aware of.
Did you know that upon purchasing a ticket you are agreeing to a massive
multi-volume contract? Most don't.
That's 'cuz they haven't. Those are called "adhesion contracts" because
the fine print adheres to the back of the ticket. The ticket purchaser
has had no opportunity to negotiate terms. No meeting of minds has
occurred, therefore, no contract.
ELUA's are another example. In both case
the vast majority of people have no idea what they are contracting so no
'meeting of minds' can be said to have occurred yet the contract is deemed
valid.
Not according to Professor Kingsfield.
