That's not the way I read it. It pretty clearly says theysupposed to be in on the gross not the illusory Hollywood"profit"side of the pot.
I'm impressed, if it means they now have a system for proving that not only did they not make a profit, they didn't even get any gross receipts. I suppose next they'll show that the Tolkien Trust owes them money.
Saul Zaentz (the guy who originally bought the film rights and sold them to New Line) and Peter Jackson have sued for similar reasons, so apparently New Line makes a habit of not paying up until they're sued.
Of course, in this case the Tolkien estate doesn't just want money -- part of the remedy they're seeking is for New Line to lose the rights to "The Hobbit."
