Washington has since changed its statutes. There is now a sliding
scale of age difference:
Victim 12 or less: Difference of more than 24 months -> rape of a
child, 1st degree;
Victim 12 to 14: Difference of more than 36 months -> rape of a child,
2d degree;
Victim 14 to 16: Difference of more than 36 months -> rape of a child,
3d degree;
Victim 16 to 18: Difference of more than 60 months, sexual misconduct
with a child, degree of 1st or 2d depending on other circumstances.
If there is only sexual contact, the same age differences apply to
victims from 12 to 16 to qualify as the equivalent degree of child
molestation, but a 36 month difference applies to a victim under 12
forchild molestation, 1st degree.
Since the Letourneau case about 10 years ago, Washington has taken
this very seriously, regardless of the genders involved, because of
the abuse of authority in that case.
