To successfully sue, you have to show actual damages. Disney can sometimes show a loss of sales or at least projected effects on sales; what's the value of what's lost in of "I'm hurt because someone made fun of me"?

Since it generally doesn't affect one's livelihood, there are no damages to recoup, thus not worth suing.

Most people can handle "He made fun of me" just fine, though, and not let it disrupt their lives to the point that they think the courts should be tied up arbitrating their tender feelings.

So, you're quite happy for someone to come along and lift your poems, paste them to their own website and claim them as their own work, yes?

You will note that I did not suggest that one has to be "happy" about it, not anywhere.

I spoke to being successfully able to sue. Just where did you get that particular reading-in?

IAC, when someone re-posts copyrighted work, there are ample avenues to act; that's not the same as suing and seeking damages. For example, the DMCA makes it very straightforward to act if someone posts copyrighted material, without permission, to a US website, outside of the constraints of fair use.

You have no problem with someone ambling through the poetry newsgroups, selecting your poems and attempting to publish them on cafepress - for a profit, all of which goes into their own pocket rather than the pockets of the people who actually wrote the poems, such as you?

Same thing; you're reading in something I didn't say.

And when it comes to someone deciding to add your poem to explicit pornographic images - with your name on them as the author - which then get displayed on that person's website for all to see, you're happy to endorse their actions?

Just mildly interested in your opinion, of course.

I think I've stated it clearly enough. It will help you, if you actually are interested in my opinion, to differentiate between what I've said and what you want to read into it.

As for whether I have ever been through it, the answer is "yes" for most of what you mention, except for the fact that it wasn't poetry.

And it's -really- a stretch for you to go from my talking about what it takes to successfully sue, to claiming I "endorse" such things.

Or was that just a very blunt sort of troll?

What you typed is what we all know.

The way you typed them seemed, to me, to be offering a tiny mote of comfort to to someone who has lost the right to such comfort through his very own actions - I'm speaking, of course, about Little Tommy Tosser.

Little Tommy Tosser has, during his tenure at the school of rap, managed to commit two of the dastardly deeds I listed (items 1 and 3, m'lud). He didn't have the courage to carry out his numerous threats to perform the other one, so instead he (and certain other miscreants) persuaded a naive young woman, new to usenet, to do it on his behalf.

When it comes to Little Tommy Tosser, it is best not to talk in generalities. He is a piece of pond scum who needs to be reminded of his disgusting little acts of criminality at every opportunity. He is an attested plagiarist and copyright abuser.

Indeed, he routinely brags of it himself.

Perhaps I wasn't clear: I know more than enough about him, including things he doesn't remember revealing publicly. I'm of the impression that the other posters who know "AJ" from ssb-b don't know the rest of it, but I assure you that I do.

But there was a -ton- of "reading in" to what I wrote, that simply wasn't there.

To be clear: I know about his posting program, I know about what I call "morphing" images that he calls something else (and arguments about the copyrights for images he's used as the basis for those), I know about his claims as a programmer, I know about his AUK awards, I know he tried to start a new poetry group a few years ago, and I know about his sexual kinks ... and a whole lot more. And I didn't -try- to find out any of that, but ... he's been around for a long time and it's hard to ignore him since he happens to show up a lot of places that I've been over the years.

So if y'all are trying to explain to me about the situation, really, it's unnecessary. And considering Tommy's spate of crudeness towards me here, it's kinda hard for me to understand why anyone would imagine that I'd be inclined to think kindly of him.

So I would appreciate if assumptions aren't made about my positions beyond than what I've stated directly. My comments in this thread were about suing for copyright & what's required to be successful, to have a case at all that is worth pursuing. If I wanted to argue "internet harassment" of any sort, well, there's always Atalanta who accuses me of being "a criminal" because she feels I'm being mean to her on Usenet. And at the moment, I'm a bit burned out on that whole routine & would rather stick to discussing things that are at least marginally sensible or entertaining.

Thanks.
