Basically, I agree wholeheartedly with Daibhid's view on
this. When the Time War wiped out both races it did so
throughout the timeline, but some races are still able to
see/remember how the timeline was before. This knowledge
could have been passed on to other races in the form of
myths and
legends, so even humans like Rodrick from Parting of the
Ways might have heard about the Daleks having existed.

It's less effort to say humanity remembers the Daleks
because they interracted at a prior point in the current
version of the timeline. Which, by Occam, is the better
explanation -- your own construct is terribly unwieldy.

That's how I see it, actually. Well more or less.

My theory has to do with the mildly controversial concept of
Gallifreyan Relative Time; the idea that the reason the Doctor
meets the Master in order is that there's some sort of law
(possibly Blinovitch) that ensures this. By the same token,
once the Time Lords and Daleks have wiped each other out, they
don't exist any more. But they're still remembered, and the
events they caused still happened.

A better analogy might be the War Lord. We *know* he was wiped
from time; the Time Lords said so. He never existed. But The
War Games still happened.
