FTR: legally owning a gun is not a crime. Holding a gun is not a
crime. Pulling a gun out and pointing it at someone who is
committing a crime in your presence is not a crime. Having an intent
to shoot that person who is committing the crime in your presence is
not a crime. There is no punishment for intending to use deadly
force.
All of that together constitutes "using" a weapon against a
"villain" who is committing a crime, and none of that is punishable.
The only time it *might* become punishable is if you actually fire
the weapon and hurt the "villain". Then you might be punished if you
fail to prove, depending on the state of course, that you had no
other choice in deterring the crime than to shoot the weapon.
It might (or might not) be *foolish* to brandish the weapon, but that
is not the actual topic at hand.
Unfortunately, Ray wins the round. You are clearly and
understandably vexed that he managed to win one in his very obtuse,
slippery manner (rare for him, but it happens), and so you're happy
to make all kinds of inferences that may be honestly based on your
inability to comprehend the full import of what Ray has written, or
may just be you smacking Ray around.
Either way, I don't really care. Just making the observation.
