How does the Hamilton County Sheriff's Office know that Joe
Duke was negligent?

The load fell off.

Well we know the load went where it wasn't supposed to. More accurately, from what has been reported, the load stayed on, but part of the semi-trailer detached, somehow. (transporting the load where the load was not supposed to go)

Yes, that is harsh.

There are rules--and as I driver I'll confess that I don't know them all--that say how often stuff has to be inspected, and how often it has to be replaced because it has been that long.....

It is stuff like that that is behind the rules about such things a load checks enroute.

Which is an interesting point. How long between the log-book entry for the most recent load check, and the failure?

Does that really matter? The load stayed on (but the semi-trailer failed), so apparently the load was being checked as often as required. My question still stands, could this failure have been spotted by a driver during pretrip? If so, then WHAT was the failure, EXACTLY?

I suspect as the details being reported are very vague, the exact failure is -not known- yet, so the citation was just because, well, when bad shit happens, people feel that -someone- must be to blame, so the driver in this case is a convenient scapegoat.

But if someone posts the exact cause of this incident, I might change my opinion quick and say that the citation was well deserved. I used to pull open deck, and oversize loads ON open deck equipment so I have somewhat of a clue what this driver's specific responsibilities were. If he was negligent, I'd like to know how it was determined that he was ligent. -Dave
