trucker's have always took it on the chin and moved on but now it
stops. Labor laws are over looked in trucking. first DAC goes then get
paid for any time on line 4 (on duty not driving) but your still

home (2) at a motel (3) away from truck and doing your thing no load
empty. (4) in the hospital or dead. line 2 sleeping per DOT
RULES ..line 3 driving per orders to get a load drop a load or move a
load from point A to point B. you get paid miles (labor laws state
every mile you drive (everyday put starting milage on log book and
ending milage on book) employer won't pay real miles don't quit just
file a claim with labor board in state you (now this is tricky) the
state you were in when employer told you,that you got the job. If you
were on phone say in ST.LOUIS,MO at a bar (just joking) and employer
called you or you called them and said "YOU GOT THE JOB" come on and
get your truck thats where all again thats where all the laws for you
are (COMP,HOURS AND WAGE YOUR HOME IF THEY LET YOU TAKE TRUCK HOME).
OK lets get to "LINE 4" working not driving (on phone calling office
of employer,shipper,recever,or counting boxs or what ever they put in
your trailer) loading-unloading siting in truck stop waiting for info
from company ETC (YOUR NOT SLEEPING,DRIVING,) YOUR WORKING. OK NOW THE
BALL BUSTER( @ $0.35 per mile 70 mph thats .35x70=$24.50 per hour)
abou 5 hours per day x's 7 days x's 50 weeks = $42,875.00 plus your
$0.35 x 600 miles a day x's 300 days per year =180,000 miles per year
ok $0.35x180,000=$63,000.00 miles driven plus $42,875.00=$105,875.00
per year. Tell me anyone in trucking,shippers or recivers office or
dock worker works for free.. It's not your truck why fuel it and clean
bugs off for free. You must do PRE TRIP INSP by law so look at what we
as drivers give to the trucking company for free. If I knew drivers
would stand behind me I'd run for office and go after the goverment
and with drivers and safety people and everyone who wants safe drivers
on the road and getting paid right drivers won't have to lie in log
books and die trying to get a truck down the road to pay his bills and
keep his job. thank you for your time.

In 2004 OOIDA filed a suit against DAC for the illegal ways the
company handled the credit reports. But did the lawsuit change the
ways companies reported? Not one damn bit. What needs to be done is to
force the companies to report the truth. Not allow them to say any
damn thing they damn well please. Then allow the drivers to have their
say in the issues. Or simply put DAC out of business.
As for mileage pay, labor laws have exempted trucking companies from
paying by actual mileage driven. Please post a relevant actual law to
back up your claim. If trucking companies paid by the hour, then
they'd have to include over time pay. That's why you get mileage so
overtime isn't an issue.
On a temporary assignment, I worked for Ryder and actually got paid
odomoter miles. On my one overnight trip, I not only got odometer
miles, I also got paid by the hour.
With most companies, if you are OTR, and they have you work local,
then you normally get paid less by the hour.
What we need to see is a change in the labor laws so that drivers get
paid for the work they do. Driving or not. Because I rarely see a dime
for handling freight on the dock, I don't. If the company can pay a
lumper $200, why can't they pay me the same?
