If I was on the jury I'd have a problem. The truck had a clear shot
at the crossing until the traffic in front of him stopped. Maybe he
should have just driven over the 4 wheeler in front of him??
road rule #1 - never get in the way of something that has wheels that
weigh more than you do.
Law, common sense, and any reasonable road rules _I_ know about ALL say don't start (big truck, 4-wheeler, or on foot!) across a railroad track unless you are sure you can get all the way safely across without stopping again. (That driver, if placarded in Michigan, committed a felony.)
