It has come to my attention that as of recent changes, that now
information that was in a drivers Dac file of which drivers did not
have readily available access, as before only information that was
pertaining to CDL drivers actions and/or convictions that was directly
related to the federal motor carriers laws were listed in the Dac
files, now I have discovered that through USIS COMMERCIAL SERVICES,
4500 S 129TH AVE. TULSA OK. 74134, when this agency did my background
check there were many errors, these errors have seriously prejudiced
my employment eligibility because of these errors, I am preparing a
administrative request to correct the errors, I was told that as of
now there is no procedures to seek review of there findings,

Well, that's completely untrue. If you have proof that can be submitted
to them, clearly demonstrating that the information offered is false or
misleading, it must be removed.

examples
of errors, 1 when a case is dropped by a judge they have it listed as
"pled to lesser offense", 2 when your under sentence for a felony and
on probation and violate the terms and conditions of that probation
and are sentenced for the violation, there reports makes it look like
you re-committed the same offence again, 3 when a case is Nolle
Prosequi or Nolle Prosed, See
http://en.wikipedia.org/wiki/Nolle_prosequi
there information shows that the case went to trial and there was a
Hung Jury, 4 also as in my state at sentencing sometimes very often a
judge will enter "Adjudication Withheld" or "Withhold Delinquency"
which means in Florida there is no finding of guilt and it will not
become part of your record as far as background checks go, and in a
civil infraction traffic case, no points will be accessed against your
record or show on your MVR,
Seehttp://www.background-checks-systems.com/criminal_definitions.htm

Okay, then submit to USIS your copies of the court decrees and
dispositions, along with the appropriate Florida codes that explain what
they mean.

This new system is going to make it hard for alot of drivers to
become qualified because these girls that are working in safety
departments with companies most have never drove a CMV or do they have
knowledge of legal terms and rationally do not have the fair knowledge
to accurately make a fair determination as to driver qualifications
for employment with that company.

They make determinations based on what is found during the background
checks. It's not up to them to discover how true the information is. It
is up to each driver to monitor potential issues, and to be ready to
head them off BEFORE they become a problem.

Anytime a driver is considering a job change, they should pull their DAC
report at least 60 days in advance, so that if there is information on
it that is incorrect, the driver can get it taken care of ASAP.

Obtaining a copy of your report:

You are allowed to receive a free copy of your report directly from USIS
Consumer Services, Inc. under the following conditions;

* A person or company has taken adverse action against you because of
information in your USIS Consumer Services Report. This means that if
you have been denied employment due to information cited by USIS
Consumer Services, you are entitled to a free report within 60 days
after you have been declined employment;

* At any time you feel that information included in your file contains
inaccurate information supplied by a former employer;

* If you are unemployed and expect to apply for employment within the
next 60 days;

* After a challenge has been submitted and information has been
corrected;

* Federal law now requires all consumers be entitled to one free copy of
any personal consumer report every 12 months upon written request, from
each nationwide credit reporting agency and any specialty consumer
reporting agencies. DAC/USIS is considered a specialty consumer
reporting agency.

If you qualify for a free report under the above circumstances, submit
the following information and required documentation to them in writing
to obtain your report;

* Your full name;

* Your current mailing address;

* Your Social Security Number;

* The REASON from the list above that you are requesting a free copy;

* A legible copy of your driver's license;

* A legible copy of your Social Security Card;

USIS recommends that you enlarge copies of the driver's license and
Social Security card images, to head off any issues that they cannot be
read easily and clearly.

If you do not meet any of the above required circumstances for
requesting a free report, you must include $9.50 with your request for a
copy of your report. It is not stated what acceptable methods of payment
are acceptable, so I advise anyone to call prior to sending the request
to verify if a personal check is okay prior to mailing your request, and
that the price for a paid report is still the same as it was at last
check.

Mail your request to the following address:

USIS Commercial Services
Consumer Consulting Department
P. O. Box 33181
Tulsa, OK 74153

You can call them at the following number with any questions that you
have at:

(800) 381-0645

Yes I did speak at lenth with an asscoiate from USIS Commercial
Services, but it would seem that the department of which to submitt my
administrative request would be here;

- USIS Screening and Information Services
4500 S. 129th East Avenue
Suite 200
Tulsa, OK. 74134-5885

although this person told me to address the request to Consumer
Consulting Department, you see I have had many dealings with large
agencies and it's very common to request administrative action from
one branch of a agency that will assert that "there department did not
compile the alleged wrong and misleading material", and to make the
request to another department, do you know if the USIS handles matters
this way ?, because I seek a simple correction in the reports not a
long and costly legal battle.
