Short of them determining that there was something wrong with the road
surface that caused the driver to lose control, it likely is driver error.
Even if it is entirely the driver's fault, the company will be liable. It
is the owner of the vehicle that its liable, and the driver is an agent of
the company. Their insurance company must be shitting mini bricks.
