10 gas-station firms catch state's eye

Attorney General Dustin McDaniel is issuing more than 30 subpoenas to 10
companies operating gasoline stations in Arkansas in order to determine
whether they were price gouging as Hurricane Ike approached the Texas
coast and supplies were disrupted.

All the stations were charging between $ 4. 29 and $ 4. 64 for gasoline
over the weekend, Mc-Daniel said at a news conference Tuesday.

If there is sufficient evidence, he will ask stations to pay restitution
and fines of up to $ 10, 000 per violation. Otherwise, McDaniel will sue
them. More subpoenas are possible in the ongoing investigation. The
stations have 20 days to respond to the subpoenas.

McDaniel said that the stations are merely being investigated and that
they are "innocent until proven guilty.... But to me the evidence is
pretty clear." For example, he said that a gallon of regular at a Kum & Go
station in Jonesboro jumped 70 cents overnight Thursday. After news of the
crackdown on alleged gouging, the price dropped 40 cents by Saturday
morning.

"To me, that's not prices that are governed by the market," McDaniel said.
"Those are prices that went up as a result of greed on one day and down
for fear of consequences on the next." Kum & Go LC was reacting to the
market conditions, said spokesman Meggan Kring. This is not an isolated
incident in Arkansas, she said - other states saw the same price
increases.
