Traffic congestion is pushing more drivers to illegally use freeway
carpool lanes, despite the threat of a hefty fine and a ding on their
driving record.
About 15 percent of vehicles in the high-occupancy-vehicle lanes of
Valley freeways don't carry two or more people or don't run on
alternative fuel, which are among the requirements for HOV access,
according to a new study done for the Maricopa Association of
Governments last year and published recently.
The study is the first of its kind in the Valley since 1992. Then, the
violation rate was 6 percent, though the Valley had just 27 miles of
carpool lanes. There were 145 miles of carpool lanes when the latest
study was done.
Eric Anderson, MAG's transportation director, said the agency will
review the new study data with the state Departments of Transportation
and Public Safety to come up with ways to get drivers to stop breaking
the rules.
He said more spot enforcement and posting the fines along the roads
may persuade drivers to mend their cheating ways.
Violation rates vary on individual freeways, with Interstate 17 and
Arizona 51 running in the 20 percent range in the morning and
afternoon rush hours, when HOV restrictions are enforced.
"Basically, there are more opportunities for drivers to use the HOV
lanes when they should not," Anderson said. "Secondly, the higher
levels of congestion results in more drivers willing to take the
chance of not getting caught."
A carpool analysis by the Texas Transportation Institute for the
Federal Highway Administration said a violation rate of 10 percent or
less is a "suitable objective." Rates below 5 percent are good. Rates
exceeding 20 percent are judged "unacceptably high."
"When you start to get into double digits, you might have to get into
ways to correct it," said Ginger Goodin, a research engineer at TTI
and one of the authors of that study.
United Civil Group, a Phoenix engineering company, did the study for
MAG.
Valley carpool lanes aren't separated from other lanes by a curb or
barrier. That makes it easy for drivers to use the HOV lane as a
passing lane or a temporary express lane.
The state Department of Public Safety couldn't immediately provide
statistics for carpool violations. DPS spokesman Harold Sanders said
the agency sometimes uses specialty patrols targeting specific
violations, such as aggressive driving, for HOV violations.
An HOV violation costs about $350 plus three driver's-license penalty
points, the DPS said.
Pat Steiner of Glendale typically sees three or four HOV violators a
day on her drive from Glendale to her paralegal job in downtown
Phoenix.
She drives a Honda Insight, a hybrid allowed in the HOV lane, and
isn't particularly fond of drivers who break the rules.
"It's against the law," she said.
"They should get a ticket for it. They just do it to avoid the
traffic."

When did I ever make a threat against you? I merely stated what was
going to happen considering you BIG mouth and you ability to mouth

Just pointing out that you have a history of nonsensical posts. In
the last month since returning from your hiatus, which you did
announce, you have made very few posts on topic. This was the first
