Because the DOT's let them be in that mode.

No, because new construction is where the money is, not in
maintenance. Construction firms lobby legislators very, very hard to
make sure there's plenty of work available for them, to the limits of
the funding. There's no maintenance lobbying groups.

You are bouncing again.

You do realize that all of the above are subject to the legislature.
And if what you say is true, it is a failure of the elected
legislature.
