Exactly what rules is this other Duine breaking?
The "rules" you refer-to are those set forth in the TOS/AUP of the access
provider, and Duine has every right to complain of what he perceives to be
violations thereof. It is the provider who interprets the merits of that
complaint relative to their Terms and/or Policies, and what action is
appropriate.
Beyond that, defamation, forgery, stalking, and harrassment are illegal, the
latter two at the Federal level as far as the Internet is concerned. That
law was passed by Congress and signed by the President for a reason.
While I don't personally think it necessary in this case, should Duine wish
to escalate the matter above the provider and complain to Law Enforcement
authorities, he has every right to do so. In that case, it would be the
Prosecutor who interprets the merits of the complaint and determines the
actions that should be taken.
