Maybe you can help me, too. I am an architect and I am writing an
article commenting on McCain's and Obama's houses and the
archtiectural styles of each. I found photos of McCain's house that
were printed in Architectural Digest and posted on the internet. If
I use those photos with my critiqe, is that "fair use?" I would
like to also use them on televsion, as graphics to illustrate my
points. Can I do that without seeking permission?

My question was a simple one about what constitutes "fair use" and it
did not deserve a smart-ass answer. I was asking the question so I
could learn something. It worked. I learned something about you, Mr.
Deadrat!
And yet you refused to learn anything from what I posted; you just got
upset. Go figure.
You can't use my drawings because they have a copyright written right
on them.
That I can't use your drawings has *nothing* to do with your copyright
message. You held a copyright as soon as you created the drawings, and
that right precludes my legally using them in toto without your
permission.
My question was about whether by posting something on the
internet, the copyright protections were altered. I would expect that
if you found some of my drawings on the internet without a copyright,
then you could use them.
Your expectations are wrong.
Foad - Thanks for your answer. I like your suggestion.
foad's suggestion was that you could do what you like because no one was
likely to see your presentation. This is like figuring you can run a red
light at 3:00 a.m. when no other traffic is around. Yeah, probably no
one will notice, but it's still against the law.
I'll leave the
photo permissions to whatever publication might carry the story.
If your article is going to be in a "legit print outlet" as foad
suggests, and you have a standard publication contract, then that
contract will probably make you responsible for making sure that your
work doesn't violate copyright. So read the contract carefully.
Now, have you figured out why your use of the photos doesn't constitute
fair use? Or are you still wasting your time and energy trying to figure
out things about me?
