I doubt incompetence is actionable, but lies probably are, if
said lies led to material damages. Heck, there might even be
a criminal fraud case if you can prove that lies were told by
the ex-employee before he was hired and those lies positively
influenced the decision to hire him, since it appears that you
suffered damages as a result of that decision.
Remember, advice on Usenet is worth what you paid for it.
Find yourself a good lawyer and pay for a consultation about
the case. S/he will be able to tell you whether it's worth
pursuing legal action. It doesn't seem clear to me that it's
not, so I'd say that it's worth investigating further.
