Sue a salesman?



I have a strong feeling that the answer is "no", but here it goes...

Employee hired three months ago as Director of Sales. Full
credentials. Same industry. Recommendations from at least one
executive at a company in the same industry...

Fired last week.

Why? Zero incremental sales. Lies. Refusal to engage in market
development program. Very little if any effort towards any sort of
plan to fire-up sales. In other words, just about a useless
individual. It was so bad that it required another exec with
different responsibilities to stay up till late at night nearly every
day just to ensure that the sales process continued.

In all over $30,000 in cash was wasted on this person as well as time
and lost opportunities.

Is it possible to sue an ex-salesperson/employee for losses suffered
due to negligent non-performance? This is in California.
