You and me.
"We the people...", elect people to represent us in OUR government.
The United States Constitution is not about, by, or for the exclusive
enjoyment of the federal government. It is FOR the people. All of the
people. Not just those in government positions.
The Constitution is about a government. There isn't a single active
provision that applies to private citizens.
All of the Amendments are "Rights" granted to the Citizens, all
persons regardless of involvement, of the United States.
You should have learned this before highschool.
You're fond of pointing out the ignorance of others, while your own is
broad and deep. No one grants rights to anyone, including citizens: we
all have them as a consequence of our being human. The Constitution is
the structure that is supposed to bind the state so it cannot violate
those rights.
Do you have the right to free speech or is that only applied to the
federal government as well?
If you say one Amendment is FOR the federal government only, then they
all are.
According to your theory then, no cop is required to read an arrested
person "his rights".
The 1st Amendment is precisely "FOR" (or in other words appllies to) the
federal government and through the 14th Amendment to state governments.
Private individuals cannot violate your 1st Amendment freedom of speech.
Only the state can do that.
Are you implying then that because the 2nd amendment uses the word
"militia", then only the federal government can declare what a
"militia" is?
No, of course not. The states get to say what their militias are.
That's the point of the amendment.
Do you own a gun? Why? According to your own words,
you're not allowed to.
Who says this? Some state constitutions explicitly make gun ownership an
individual right.
No one is. Not even that cop in uniform.
Who says this?
Because he's not the federal government.
The 2nd Amendment isn't about granting rights; it's about restricting the
federal government.
Look it up on google. "Militia" means a civilian military. That means
you and me. So the 2nd Amendment does in fact apply to each and every
citizen of the United States.
The 2nd Amendment, like the rest of the Constitution, applies to
government, in this case the federal government.
Not just the government.
Because it is not restricted in the Amendment, states can legally
control who is allowed to become part of that militia.
Of course. And if they say the militia is all private parties who may
therefore own guns, then so be it. If they define things otherwise, so
be that.
As for marijuana, the DEA has busted california residents for growing
medicinal marijuana because, "There is no such thing as legal
marijuana", and there is not a damn thing California can do about it.
Ask them yourself.
Of course. That's because SCOTUS has declared marijuana in any guise as
controllable under the commerce clause. What does that have to do with
this discussion?
