Reading in another group, it appears that the 2nd amendment will be
heard and decided upon. Specifically, the legal right of a city, (Wash
DC), to ban ownership of a gun.
So I was wondering, how will this effect the requirements of say, NYC,
that requires a person to obtain a license to legally own a gun within
the city?
Larry, if you would kindly post the link to the law itself, I would
like to read it.
Let's say for example that I am a Florida resident. I own a gun all
nice and proper in the state of Florida. Let's say I'm travelling to
NYC to move into my new home on Manhattan Island. Before I even reach
my destination, not even on the island, I get into a little fracas
somehow. The cops come, search my belongings and find the gun. Which
is properly secured and locked.
Over the years, from what I've heard from well meaning truckers, and
even seen on tv shows, I'd be busted for merely having the gun in the
city limits simply because I do not have a permit. Even though I am
not a resident. Does the law apply ONLY to residents?
Of course not. The law applies to anyone within jurisdiction of the
state. Do you suppose the New York laws against illegal homicide don't
apply to you because you're a Florida resident? Or only because Florida
has similar laws?
Or any one who
travels through the city? If the cops confiscate the gun, do I get it
back?
It depends on what the law says.
I have no qualms over the issue of requiring a license. I do have
qualms over that requirement being forced upon visitors who are NOT
residents. Specially from another state.
Why? You're *in* New York. New York laws apply to you.
