Mall security has absolutely no sensitivity in helping when the need
arises. Instead, they would prefer to harass you, call the cops and
have you kicked off the property.
You think they'd prefer this? They'd have no job if no one was allowed
on their property!
Then the real cops show up and only back up the mall security.
Why the fuss? Because a guy couldn't find his car, went looking for
it, and was reported to security as being a person who was trying to
break into cars. The only thing of interest to security, was to get
the guy off the property. Not caring one bit that he'd be leaving
behind his expensive car. AFAIK, security hadn't even bothered to
assist the guy to look for his car. In their mind, he's a thief.
Gosh, Richard, could that be because "mall security informed police they
saw DiSalvo trying to break into cars. Someone at Macy's, police were
told, saw the same thing."?
Maybe they misinterpreted what he did, but imagine if the police or mall
security got this report about someone, and chose to ignore it or left
the guy along because he claimed he was looking for his own car - and
then the person actually did steal a car.
So ok, the guy leaves the property, and is then seen by others
"running" across the heavy traffic intersection. The real cops take
that to mean he was running from security. Evading them.
With the security cops telling the real cops a totally different story
about the guy.
The guy told the cops a different story than mall security. It's a
matter of perspective. Running across a busy street, away from mall
security and away from where your car is parked, could reasonably be
construed as fleeing, even if its not truly what the person was doing.
Then the guy is cited by the cops, at the mall's request, for
trespassing. Then the insensitive mall bans the guy for life.
The guy was NOT cited by the police for anything, Richard. The *mall*
gave him a trespass notice. Major department stores do this dozens of
times a day all over the country. Stores, and malls, are private
property. They can decide who is allowed on their property and who
isn't (as long as they don't illegally discriminate against a protected
class).
All of these headaches, caused by a simple act of forgetting where one
parked his car.
Wonder if the guy will sue the mall, security, and the cops?
For what? He wasn't arrested.
* violation of civil rights...maybe.
What civil right of his was violated? Name one. You don't have the
right to shop at a mall that doesn't want you there.
* grand theft auto....just to make it juicier.
You can't sue people for "juiciness," Richard. That's called a
frivolous lawsuit. Besides, they didn't steal his car. Oh, and "grand
theft auto" is not a civil cause of action.
And maybe a few dozen other things the attorneys will throw in.
You've yet to name one, I don't know of dozens more claims out there.
Not to long ago, I was at a florida truckstop trying to get fuel for
my truck. The first pump quit working, after I entered the fuel card.
I told the clerk via the phone at the pump. She sends out mechanic to
look. I wind up switching pumps. Now I can't use the card because it
won't let me do two transactions so close together. So now the clerk
has to manually turn on the pump for me.
Inside at the fuel desk, you can easily get the idea it's been a bad
day for the clerk. So she's irritated as hell. She's had quite a
number of cards fail that shift already. So she jumps on my case.
Twisting the story around and telling she's gonna call the cops and
have me tossed out for trespassing. Be my guest honey. When they show
up, I'll file charges against you and "truckstops of america" (TA).
Then file a lawsuit against the company. Now if you'd just back off on
that attitude a bit, I'd be on my way and out of your hair.
If she worked there, and asked you to leave, and you didn't, you were
trespassing, Richard, whether or not you did anything wrong.
It just seems to me that lately, in the past 5 years or so, lots of
people just don't give a damn any more. Seems to me illegal aliens
have more pride in this country than the natives do.
Who says this is about pride, or immigration? Or are you just being
racist again?
