do I have a chance suing my neighbor who promised to pay half a survey
fee then changed his mind when I ordered the survey? nothing written
just an oral agreement.
I know worth the paper it was not written on.
but would the judge listen.

You have a chance. Oral contracts enforceable. If the defendant doesn't
deny the contract, you might win. If the defendant denies it, you might
lose. You don't need to know the statute. The small claims judge will
accept the idea that an oral contract is enforceable without you specifying
the law. But if you want to know the actual law, tell us what state you are
in and someone here might know. Or you can look it up. Do an internet
search using
"oral contract"+enforceable+"North Dakota" as the search term, with the
quote marks and plus signs, substituting the name of your state. You will
probably find the actual law that way.
