Petitoning Last Will and Testament
I'm trying to write a legal situation in a novel idea I'm working on.
Let's run a couple of hypothetical situations if you're willing to
indulge me.
Who cares? It's purely fictional right? You write it to your needs and
desires. Oh sure, you're gonna get some feedback from some righteous person
stating that this ain't right and it ain't gonna happen that way in real
life. Do I care? It's my own private little fantasy world.
I'm sure you've seen the old tvs show "Matlock"? I've always wondered just
how many of those cases he would have lost in real life? How much evidence
would have been thrown out of court if it weren't fiction. Do you really
think any real judge in a real court room would let him get away with all
those theatrics of his? Hell no.
One of the cases I always remember is one where he bluffed the real killer
into nearly admitting that he was in fact guilty. How? With a coin. He
stands before the witness with an envelope containing a simple quarter.
"We obtained this quarter out of the phone you used at the scene of the
crime. Do you know what we found? Your fingerprints.........."
Yeah right. Ok so here's my script for the response.
"Really? That's most interesting. Your honor sir, would you order the
attorney here to enter that coin into official evidence? Then, I will have
the court order that that coin be examined right here in this court room. I
am no expert, but I do know that there are various surfaces from which
fingerprints can not be lifted. Coins are one of them. Why? Because of the
thousands of ridges that would make obtaining a readable fingerprint almost
impossible. [pulls quarter from his pocket]. Now here you go Mr. Matlock, as
you can see I am clearly holding this quarter with my fingers. Even your own
fingerprint expert should be able to lift my prints from it right? You can
also see that by the way I am holding it, as if about to place it in the
slot, do you see now how difficult it would be to obtain fingerprints from
it? So go ahead sir. Place that coin into evidence and we'll see just how
much of a winner you are."
So it's all done for the dramatics. Not for legal issues. Hell, if it were,
the show would have been cancelled the first season. I've also wondered how
many of "Colombo's" cases would have been tossed out of the courts. Purely
for dramatics.
