Howdy,
My wife was the only child of her mother and father. Her father had one
sibling, a sister. When my wife was 3 years old, her parents divorced
and shortly after that, her father died. Years later, when my wife's
grand parents died, her aunt (her father's sister) took over the
parents house, moved in and stated that it was soley hers along with
the rest of the estate of her parents (my wife's grand parents). I
contend that my wife has a claim to that house and the estate.
Questions about a will are schetchy at best. All things being equal,
would my wife have claim to that estate including the house as she is
the only living descendant of her father. I say that since he died, she
takes his place, if you will, as she is the only living descendant. Any
thoughts? Thanks in advance.
Unless/until you report more clearly when and where the events in
question occurred, what a search in the relevant land records office
search tells about who owns the property in question and what a search
in the probably relevant court(s) re. whether a will was or was not
probated and what you mean by "sketchy" in terms of who did or did not
leave a will providing or not providing for your wife in what if any
way, there cannot be any way even possibly informatively to guess much
less reliably to advise what entitlements your wife might
realistically claim or whether it is or is not probably too late for
her to do anything.
