Quick background.
I am a UKC living in the UK with my US Wife. I have applied for a job
in the US (who has UK and US companies within the group) and am doing
very well in the interview process. I am flying out to the US in the
next couple of weeks for the final face to face. We have in the
meantime filled our I-130 at the US Embassy in London and I reckon it
will be approved around Dec/Jan.
I posted in the USA forum regarding the possibility of working in the
US until my spousal visa is approved. The guys there agreed that
without a work visa or some sort I couldn't do it. I kind of knew the
answer before I posted so was happy with the answers.
The company however have been doing their own research and have now
come back to me and said that their "Corporate Lawyers" have said that
I could be employed by a UK sister company and then legally travel to
the US to work (in what capacity I have no idea). I am very unsure
about this and will ask for exact details when I travel over for the
interview.
At the end of the day I don't care how it is done but I don't want to
jepodise my spousal application. The last thing I want is to attend
the DCF interview in London and be questioned why I was spending so
much time in the US. I also don't want to be told one thing by a
lawyer, travel to the US to work and then be sent home cause I said
the wrong thing at immigration or don't have the correct visa. If I'm
sent home that could endanger the visa application and I'll forfeit
the job before that happens.
Can anybody figure out what this lawyer is on about and how he thinks
I can work in the US when employed by a UK sister company?
Could he be suggesting I enter the US on the VWP and just say
something like I'm a sales person or even just visiting the US sister
company to help them with something ?
Don't forget it's the company's lawyer, not your lawyer. And as such,
their bad advice probably won't come back to bite them. But it'll most
probably bite you.
