Re: 221g -- Administrative Review




Hello Everyone,
I have some questions and would like your help and suggestions in
this
matter. My husband went to the Delhi consulate for H1 stamping
and
his
name got a Hit in the database and they gave him a form 221g and
it
states that the application needs Further "Administrative
Processing".
with this, they sent him back home and said that he should wait
for
them
to call him. If anyone has had the similar situation before,
please
help with the following questions:
1. Approximately how long is the wait before the embassy gets
back to him?
2. Since he had gone for H1, can he now go for an H4 based on my
H1
or
is it better to wait for the decision on the H1 ( i think i'ts
better to wait) ?
3. If we have Canadian immigration done, can he come to Canada
and
try for an H1/H4 from Canada even though his H1 approval was
sent to India?
Any help and/or ideas will be sincerely appreciated.

I am in the same situation as yours. My girl fiend is struck in
india
for the same reason. Is ur husband back to US, if yes then on
which visa
( H1/H4).
How long did it take for his security clearance.

Hi....
Sorry about your situation... it took us 6 months to get a response
from
the embassy in Delhi. There's nothing much that you can do except
wait... we also got the senator's office involved....If you need more

Thanks for responding back. BTW is ur husband back to US, if yes then

Heres my case :
My girl friend and i were staying together, we both were on H1 with
different employers. The company with which my girlfirends H-1 was
filed was closed out by INS in the month of Sep 2005 and we werent
aware about the situation until Jan 2006. As soon as we came to know
about this we filed her a different H-1 with a different employer.
Her H-1 got approved but she wasnt granted an extension of stay.
She had to go back to india , calcutta for stamping last week
05/10/2006. The visa office gave her 221 G security clearance
reuqired and told her to contact back after a month. I am very much
concenred for her:
1. what if they donot provide any resolution, should we wait for some
response, or is there a chance that i can marry her and get her on
H-4 without worrying about the response from the consulate.
2. In case she gets a response back with in one month and she applies
for visa again and if the visa gets rejected, will there be any
problem if we reappear on H-4 basis after marriage.
