Survey/ prop. line dispute w/neighbor

when we bought our country place, we were told there was an encroachment
the neighbor said he would pay one half of the survey cost.
Then when we were about to have the survey done, his wife said "Oh we
can't afford that."
Turns out they were over onto our property. they did move the fence back,
but we are sure they won't honor the "verbal" promise.
Do we have to "eat" the cost $1800.00 or .........
my wife doesn't want to do "Small Claims"
WTD?
