Mold decomposes material, which compromises its strength so whether you
believe mold is a health problem or not, it IS a problem to building
materials that are rotting. Whatever the builder did, he may have done
to make it appear he remediated the mold in case you later sue him for
mold. But be clear that it is the leaks that lead to mold growth and
rotting materials that is the problem. Not that mold exists everywhere.
I tend to agree with Rich on this one. The OP says the stains looked
like mold, but was it ever tested? Was it a harmful mold? On the
other hand, I wouldn't think the builder would want to shell out money
unless they knew it was in fact mold. I've never heard of mold before
in new construction, where houses are exposed during construction.
Now you are left with an interesting issue concerning resale. If it
was not indeed mold, you would have been better off not having had it
treated, because you are right that it might come up on a future home
inspection where the paint can be seen. A lot depends on how many
areas there are, how obvious they are, etc. IMO, unless it was a
dangerous mold, it would have been far better had they treated it with
just scrubbing it down with bleach
On the other hand, I'm not sure exactly what you can do at this point.
You could ask for a discount from the builder, or see if they will
let you out of the contract, but I would think you'll probably have to
have your attorney get after them to get anywhere.
