prospective buyers (or their inspectors) will see the paint marks in
the basement and attic. Is this something they should be concerned
about? Will this cause an issue during resale ? Also will this affect
the value of the property? We will be closing in May, Should we ask the
builder for a discount or anything else that we should do to protect
ourselves ?

I'm curious - did you ever get an *independent* analysis that confirmed
that the house actually had toxic mold?

Because, I'm sure you realize, houses have been rained on and snowed
upon while under construction for ages. Even if the roof is on, it
still gets in from open window frames, walls without sheathing, etc.
Sometimes it doesn't dry out for weeks at a time, gets stained, but
is none the worse for wear.

Therefore, my initial response without other supporting information
is that the remediation company saw a great opportunity to capitalize
on a few innocuous stains.
