I have ripped my Eddie Izzard dvds, that didn't have subtitles, and
have now found subtitle files that seem to fit them (if played in vlc)
but I want it to be embedded for AppleTV.
Note that I don't want to use a tool like Submerge to re-encode the
entire video track with the subtitle "rendered" on top of it. My
wife's family is italian so I was hoping to add both swedish and
italian subtitles to some other videos
Anyone knows how this is handled and how I convert standard .sub/.srt
files to be embedded this way?

I have been trying in vain to do the same thing. I don't think you
will have to recode the video but one will have to repackage the mp4.
Trustfully, I haven't been able to find great documentation on the
Apple implementation of the mp4 standard.
If you haven't already check out doom9.net, the forums there are
really helpful. They are fairly windows\Linux centric but many of the
tools have OSX equivalents. I haven't had a lot of time to fiddle so
you may come up with a workflow very quickly.

If you get an process please let me know. I can get subtitle to work
(not burned in) when using Nero but they only show-up in Nero's
Showtime player (no OS X version) and the resulting mp4 doesn't play
in quicktime\itunes.
Again, I am by no means an expert but I have been trying to get my DVD
collection into mp4 files for media streaming in the house for the
past few years. My current solution is to use itunes\apple tv\mac
mini but the result is still not as good as a dvd (video is fine, lack
of menu and subtitles is frustrating).
