I should have been more clear - why not the upgrade for free?

It will cost Apple money to send you a second set of the songs, which are
larger files then the first ones you bought. The upgrade fee also avoids
having to deal with people now buying the cheaper versions then getting a free
upgrade to the more expensive ones.

It actually is very, very fair: you can get either the cheaper or the more
expensive product, and if you decide to move from the cheaper to the more
expensive later, the cost is *only* the difference, even though Apple has to
provide the bandwidth for both. I would not have seen it as bad if Apple
had added a five cent upgrade fee or something like that... yet people will
whine even now. Oh well.
