When an Abandonware site isn't really one

Found a website listing 1000s of old games but the thing is you pay to
get them, and I'm certain some aren't abandonware yet. They aren't
listed on the abandonware ring either. (Sorry no link - don't want to
advertise them.)
However there's a few ancient games on there that I wouldn't mind
paying for. Does anyone know what the rough possible (legal)
consequences of paying to access a site such as this might be? Are
people taken to court over things like this, or is this considered too
small fry for software protection organisations to take much notice
over? (I'm in the UK; I think legal issues such as this vary from
country to country.)
