I would say that using a CNAME as an MX record is more frowned upon than illegal as this is a commonly accepted practice. The most important thing is that the MX record resolve to a name, not an IP, like some domains I've had to brow beat administrators of.

Both, your opinion and mine are just a couple of the predominant schools of thought on this issue.
