Defining patterns - PS CS2

I am trying to define a pattern. I have the layer active, the layer
has pixels on it, I am using a rectangular selection and when I go to
Edit>Define Pattern it is ghosted. I have done this many times in the
past so when it stopped working I run out of things to try pretty
fast.

Thanks,
Ron
