Basically, you are claiming that the distribution through the internet is
*with* permission of the copyright owner? Or maybe you are claiming that
downloading is not a part of 'distribution'?
The person downloading is not reproducing, distributing, performing, plublicly displaying, or making a derivative work.
The person offering it for download is.
