I wonder. Does "thirty years" in Italy mean 30 years? Most places
in the US, it would mean somewhere between 5 and 20 years. Similar
question for a life sentence.
A stipulation for any country wanting to join the EU, is for the
country to abolish capital punishment from their land. IIRC, Italy has
been one the staunchest supporters of this stipulation, and most the
country is adamantly against the death penalty.
I find myself thinking that there are cases where I would support the
death penalty. None of the case I see in the US would be one of those
cases.
Even then, the most restricted imprisonment one could have without
violating the "cruel and unusual punishment" clause for life without
the possibility of parole would be far worse punshment for almost
anyone than death would.
I just think it was criminal to kill McVeigh, when he could be kept in
solitary for year on end.
No conversation at all, no contact wtih the outside world, 24 hour
lights and surveilence, never a view of the sky, nor any way to tell
if it is light or dark, summer or winter outside nor how many years he
has been imprisoned.
then for the first year or two, have some "sympathetic" questioner
ask him for more details - it being the only human voice he ahs heard
in months.
Then after a while, make "the talk" every couple of years.
We would find out more about what happened, I think.
Of course, when the prisoner actually loses their mind (as most
would), then failure to treat would be "cruel and unusual." You
would want to intervene if the prisoner made some serious suicide
attempt. so maybe i'm being a Polly-Anna here .
(This is only for the most serious of aggravated, multiple murders, so
I'm not recommending it for Knox, should she be convicted.)
