There's also a direct correlation between
duration of recording and the quality, like a VCR tape. So yeah, the
kid could have it in his pocket going all day.
I doubt being in the pocket of some school kid
would result in the kind of quiet time to allow it to pause.
The problem is context
Especially if the comments were in reference to activity the day or days
before the recording was made
as well as sound quality, not to mention that you're not legally
allowed to record someone without their knowledge and consent.
I think some states it's only one party's awareness
in others both parties have to be aware and consent to it
It definitely depends on the state.
The
stepfather's comment about how the teacher should be held accountable
if his kid is screwed up alarms me, though.
If the kid's screwed up enough to involve surreptitious activity,
maybe a good hard look at pappy would be in order too?
Step-pap is a techno-lover too, I bet? And maybe a creep to boot. But the
teacher? I'm thinking kid comes home telling stuff to parents, parents talk
to teacher, and teacher denies all and is as sweet as pie. And more than one
parent has also found this to be the case (I'm speculating the school had
other complaints, resulting in the teacher's suspension)? If the teacher was
angry or nasty on the recording, surely the reason for her anger was also
recorded. These children are FIVE YEARS OLD. They're not armed, drugged,
dangerous teenagers. Yes, nerves may get frayed, but Mrs. Teacher ridiculing
her 5yr old student in front of his classmates (or any other time) is NOT
ON. Apparently the school admin feels the same way, to their credit. Yes, it
may also be that step-pap is an AH. Lots of parents are unpleasant with
teachers. But experienced, good teachers handle it. All the time. (And
dum-dad is pro'bly also setting up for a friv lawsuit. Whateryagonnado?)
