Hearing denied for man guilty of attacking wife
Tribune staff report
Published June 29, 2007
A Bull Valley man convicted of trying to kill his wife lost a bid for
a new trial Thursday when a judge denied a request for a hearing on
alleged improper conduct by a juror, prosecutors said.
McHenry County Circuit Judge Joseph Condon ruled that the juror did
not discuss facts of the case with her husband while the case was
pending. A jury convicted Billy Cox, 66, on April 11 of attempting to
murder his wife, Carolyn, 65. Cox is awaiting sentencing.
Court records indicate that Cox's attorneys will present additional
arguments for a new trial based on prosecutors being allowed to
introduce evidence of past domestic abuse and a change of venue being
denied despite extensive pretrial publicity.
Cox's next court date is July 16.
Cox was convicted of hitting his wife with a blunt object and leaving
her in an unventilated garage with vehicles running.
