Massey hires lawyer for murder defense: Hearing held in Griffeith
deaths

CLINTON - An Ohio firm has been retained to assist the defense in the
capital murder case against a Clinton man accused of killing a
pregnant mother and her son in July.
Arthur Thomas Massey, known as Tom Massey, smiled and nodded at his
parents before a brief case management hearing Thursday in DeWitt
County Circuit Court.
Massey faces six counts of first-degree murder in the deaths of Katie
Griffieth, 29, and her 8-year-old son Kendall. He also is charged with
three counts of intentional homicide of an unborn child. Griffieth,
who was pregnant, and her son were found stabbed to death July 11 in
the family's home in Hallsville.
Massey, 37, has pleaded not guilty.
Lead defense counsel James Elmore of Springfield said a Dayton, Ohio,
firm has been hired to assist with DNA testing of evidence.
Elmore said the defense has received 640 pages of material and a
variety of photographs from the state since charges were filed July
20. Also present for Thursday's hearing was DeWitt County Public
De;fender Richard Goff and Joe Miller and John Hanlon from the state
appellate defender's office.
DeWitt County State's Attorney Jerry Johnson will handle the murder
case with assistance from Charles Colburn with the state's appellate
prosecutor's office.
Goff told reporters after the hearing that a psychological test to
determine Massey's fitness to stand trial will be conducted soon. The
defense filed a motion requesting the evaluation, citing concerns that
Massey may not be able to assist in his defense.
Goff could not predict when a trial date may be set for Massey.
"We're at the very, very beginning of this case," Goff said.
The upcoming schedule of proceedings is to be reviewed on Dec. 4.
