I think this is a horrible miscarriage of justice. I have been in the
rock and roll business for almost 20 years, toured all over the world
and worked stadiums to sh!t dives. The fault is not this guys, even
though he was technically the one who threw the switch. The band, who
amazingly has not been talked about at all, are the ones who demanded
the pyros. Not the tour manager. They bought and paid for them, they
told him to set them up, and he did as he was commanded. The club also
knew full well that they had pyros, because the band crew would have
asked somebody there where a safe place to set them up would be.

The club also knew about this because one of the owners is a reporter
for the local news and had a camera crew there specifically to talk
about safety in a small club environment. As a reporter, you think he
sucked at his job so much as to not know about the pyros? And besides
that, the state is so stupid for not requiring a basic sprinkler system
to be installed in a place where people are drinking and smoking. And
of course the club had cut corners buying inexpensive packing foam to
deaden the place instead of acoustic foam which is treated to be non
flamable.

Nobody wanted the outcome of this to happen. If you are going to claim
negligence, place the blame where it is deserved. The Band and The
Club.

Actually, I find it a mistake to blame the band, too. If they were
assured that it was safe to use pyrotechnics, then they (meaning both
the band and Biechele) acted in good faith. They did what they should
have done - and that's to contact the appropriate persons and gain
their assurance that the display was safe. What more could they do?

Blame the club owners, but not Biechele and the Band.
