But that was his *second* violation of probation for carrying a weapon,
wasn't it? IIRC, he was picked up earlier for a curfew violation. Out very
late at night/early morning, armed with a knife of some sort???
Yes, he is a convicted murderer, yes he
grieviously violated his probation and should be punished, but 30 years?
this doesn't even entail the robbery charges which in the eyes of the
law is much more serious. He can easily be sentence to life in prison.
I am all for punishment for felons who violate their probation, but
half of this is just as the Defense attorney puts it the involvement of
"Third parties" who would rather win or lose at all costs then find a
semi-rational punishment/treatment, and a Judge who seemed to think that
maximum sentences like this is a form of justice.
Lionel had been in *treatment* while he was incarcerated for the four years
was it? Prior to his original sentence being over-turned and letting him
out of prison. In less than a year, he was picked up at least two times I'm
aware of for probation violation, and his crimes had been increasing in
severity.
I don't doubt that Lionel Tate brutally murdered a six year old girl.
He hit her so hard that he lacerated her liver and gave her multiple
skull fractures, which is no small feat. He was also 12 years old, and
it showed during that trial by following the advice of his mother.

He's still following the advice of his mother, who consistently tells him
"It's not *your* fault, it's the fault of everyone else." That was what
the teachers at his school had testifed to at his original trial. That when
he'd get into trouble at school, his mother would come in, dressed in her LE
uniform, complete with weapon, and DEMAND that it wasn't Lionel's fault.
What ever trouble he'd gotten into was the fault of someone else.
