Because they can't do that without a warrant. But when you throw
something away (like utensils), anyone can come along and pick it up,
including the police, without a warrant.

LittleJohn should challenge this, because NY has something called
'cloture', where police CANNOT go through someone's trash in order to
get evidence, without a warrant.
This would amount to that.

His DNA was on file iirc (not sure what circumstances cause one's DNA to
be retained "on file", but it seemed to have something to do with his
having been incarcerated). I think the report that they checked his used
dinnerware was juat a false report.

The blood on the plastic cuffs was matched to DNA collected from
Littlejohn early last week. While Littlejohn was questioned at the 75th
Precinct, NYPD detectives bought him Chinese food and saved his eating
utensils, along with a plastic cup from which he drank.

Another DNA sample collected from Littlejohn when he was serving an
armed robbery sentence in 2000 was marked with one of his five aliases,
Jonathan Blaze, the name of a comic book character. Last week's
sample was recorded under his given name.

"Initially, we thought the blood on the cuffs was hers. We could
not find any cuts or scratches on him during questioning," a source
said. "There was a lot of jubilation in the squad when the call came
that the blood was his."

The source said other evidence collected may also bolster their case.
"There was hair recovered. We are waiting for that to come back from
the lab."

St. Guillen's hair was crudely chopped before her naked body was
dumped.


I remember reading (yesterday, after the NYPD announcement) that some
cat hair (DNA?) was a match with Littlejohn's cat; this detail goes
unnoticed in most news stories, and I just don't remember the source.

Carpet threads found on the tape used to wrap St. Guillen's body also
matched red carpet threads found in his Jamaica, Queens, home. Also in
Littlejohn's home, investigators found the back seat of Littlejohn's
van, which had been removed from his vehicle. His cell phone records
also place him near where St. Guillen's body was found at the time of
her death. Cat hairs found on the blanket used to wrap her body were
also a direct match to Littlejohn's cat, police said.

ABC News has has learned that animal hairs found on the blanket used to
wrap the victim have been traced directly to Darryl Littlejohn's cat.
But his lawyer this morning was skeptical.

Kevin O'Donnell, Suspect's Attorney: "I want to know who recovered it,
how was it was recovered, where was it was recovered, what was done
with it, who tested it, if it needed to be retested, why did it need to
be retested. Those are questions I don't have answers to now, that I'm
not going to have answers to until I receive the reports."

The commissioner said there is other evidence that links Littlejohn to
other crimes, including ABC News has learned, a DNA connection to at
least one unsolved rape case.
