Hackney Pleads Guilty

(09/29/05 -- RALEIGH) - A Cary man is behind bars after pleading guilty to
attempted sex crimes against an 8-year-old girl.
Daniel Hackney's case captured the Triangle's attention earlier this year.
Employees at local Target stores tipped off police as Hackney stood at photo
kiosks, printing what appeared to be nude pictures of a little girl.
Hackney appeared in a Wake County courtroom Thursday, where he pleaded
guilty, apologized and begged Judge J.B. Allen for mercy. Eyewitness News
was the only TV station in court to cover the plea.
"I want to apologize to God for sinning against him and to the victim and
her family, who I dearly love," Hackney said.
Allen, a visiting judge, showed little sympathy.
"It's sick for a 66-year-old male to want to have sex with an 8-year-old
child, but more importantly, it's dangerous," he said.
Hackney tried to correct the judge, saying he never intended to have sex
with the girl. The district attorney says the pictures, taken at Hackney's
Cary home in January, showed the girl, whom he was babysitting, posing nude
with sex toys while Hackney masturbated.
Judge Allen told Hackney it did not matter whether he intended to have
intercourse with the victim.
"The things you did, a 66-year-old male shouldn't be doing with 8-year-old
girls," Allen said.
"Absolutely," Hackney replied. "I have grandchildren. If somebody had done
this to them, I would have been madder than you know what."
Prosecutor Frank Jackson says he agreed to a plea-bargain for attempted sex
offenses only to avoid having the victim testify.
"I'm entering this plea, which I wouldn't normally negotiate, after talking
about this and what should happen with this case with the victim's mother,"
Jackson said.
He said the victim is receiving counseling and doing as well as could be
expected.
Allen sentenced Hackney to a minimum sentence of 10 to a maximum of almost
13 years in prison. The judge said Hackney was lucky.
"Had we tried this out before a jury and a jury found you guilty, you'd be
in prison for the rest of your life," Allen said. "I'd have seen to it."
